1. About TCG Market

TCG Market Pty Ltd ("TCG Market", "we", "us", "our") operates a peer-to-peer marketplace platform at tcgmarket.com.au that connects buyers and sellers of trading card game products in Australia. We are a marketplace platform, not a retailer — we do not own, sell, or ship the items listed on our platform.

By accessing or using TCG Market you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

2. Eligibility

To use TCG Market you must:

• ›Be at least 18 years of age, or 16+ with verifiable parental consent
• ›Be a resident of Australia
• ›Provide accurate and truthful information when creating your account
• ›Have a valid email address and payment method
• ›Not have been previously banned or suspended from TCG Market

3. Accounts

3.1 Registration

You must register an account to buy or sell on TCG Market. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.2 Accurate Information

You must provide accurate, current, and complete information during registration and keep your account information updated. Impersonating another person or creating misleading profiles is prohibited.

3.3 One Account Per Person

Each person may maintain one active account. Creating multiple accounts to circumvent suspensions, manipulate ratings, or gain unfair advantages will result in permanent bans.

4. Buying and Selling

4.1 Listings

Sellers are responsible for ensuring their listings are accurate, complete, and not misleading. All listed items must be in the seller's possession and available for immediate sale. Listing items you do not own or cannot deliver is prohibited.

4.2 Transactions

When a buyer purchases an item or an offer is accepted, a binding transaction is created between the buyer and seller. Both parties are legally obligated to complete that transaction. Sellers must ship within 3 business days of receiving payment unless otherwise agreed in writing.

4.3 Prices and Fees

All prices are listed in Australian dollars (AUD) and are inclusive of any applicable GST. TCG Market charges a platform fee on each completed sale. Current fee rates are available on the pricing page. Fees are deducted before seller payouts are released.

4.4 Prohibited Items

You may not list items that are counterfeit, stolen, prohibited by Australian law, or otherwise not permitted under our Prohibited Items Policy. See our Prohibited Items page for the full list.

5. Payments and Payouts

Payments are processed through Stripe. By using TCG Market you agree to Stripe's Terms of Service. Sellers must connect a Stripe account to receive payouts. Payouts are held for a period after delivery confirmation to allow for dispute resolution, then released to the seller's nominated bank account.

TCG Market reserves the right to withhold payouts during active disputes, investigations, or if we have reasonable suspicion of fraudulent activity.

6. Disputes and Refunds

If a transaction goes wrong, buyers and sellers should first attempt to resolve the issue through our messaging system. If resolution cannot be reached within 48 hours, either party may open a formal dispute through the TCG Market dispute system. Our team will review evidence from both parties and make a binding decision. See our Refund Policy and Buyer Protection for details.

7. Prohibited Conduct

You must not:

• ›Engage in fraud, misrepresentation, or deceptive practices of any kind
• ›List or sell counterfeit cards or products
• ›Manipulate reviews, ratings, or search rankings
• ›Conduct transactions outside of TCG Market to avoid fees ("fee avoidance")
• ›Harass, threaten, or abuse other users
• ›Use automated tools to scrape, spam, or manipulate the platform
• ›Attempt to gain unauthorised access to any part of the platform
• ›Violate any applicable Australian laws or regulations

8. Intellectual Property

TCG Market and its content, features, and functionality are owned by TCG Market Pty Ltd and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

By uploading images or content to TCG Market, you grant us a non-exclusive, royalty-free licence to use, display, and distribute that content in connection with operating the platform.

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, TCG Market's liability for any claim arising from your use of the platform is limited to the greater of: (a) the fees paid by you to TCG Market in the 12 months preceding the claim, or (b) A$100.

TCG Market is not liable for: loss of profits, loss of data, indirect or consequential damages, or any damages arising from transactions between buyers and sellers.

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded by contract.

10. Termination

We may suspend or terminate your account at any time for violations of these terms, fraudulent activity, or at our sole discretion with or without notice. You may close your account at any time through Account Security settings. Outstanding obligations (unpaid fees, active orders, open disputes) survive account termination.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

We may update these terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Your continued use of TCG Market after the effective date constitutes acceptance of the updated terms.
